    1. Acceptance of the terms

    By accessing and using the services of Creativos Digitales ESP, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you should not use our services.

    2. Description of services

    Creativos Digitales ESP offers digital marketing services including, but not limited to:

    • Web design and development
    • SEO and search positioning
    • Digital marketing and online strategies
    • Social media management
    • Online advertising (SEM)
    • Digital consulting

    3. Use of the website

    You agree to:

    • Provide truthful, up-to-date information
    • Not use the site for illegal or unauthorised purposes
    • Not attempt to access restricted areas of the site
    • Not transmit viruses, malware or malicious code
    • Respect intellectual property rights

    4. Quotes and hiring

    Quotes are estimates based on the information available at the time of the enquiry. Final prices may vary depending on the specific requirements of the project. All services hired are subject to a specific contract or agreement detailing scope, timelines and particular conditions.

    5. Payments and invoicing

    • Payments are made as agreed in each contract
    • An initial payment of 50% is generally required before the project starts
    • The remaining 50% is paid when the project is completed
    • Maintenance services are invoiced monthly
    • Overdue payments may lead to suspension of services

    6. Intellectual property

    Once the project has been paid in full:

    • The client owns the final design and customised content
    • Creativos Digitales ESP keeps the right to show the project in its portfolio
    • All website content (texts, images, logos) remains the client's property
    • The source code remains the property of Creativos Digitales ESP unless otherwise agreed

    7. Warranties and support

    We provide technical support for the period specified in each contract. We guarantee that the website will work as specified. However, we are not responsible for problems caused by third parties, unauthorised changes or factors beyond our control.

    8. Limitation of liability

    Creativos Digitales ESP shall not be liable for indirect, incidental, special or consequential damages arising from the use of, or inability to use, our services. Our total liability shall not exceed the amount paid for the services in question.

    9. Cancellation and refunds

    Cancellation policy:

    • The client may cancel before the project starts with a full refund
    • Once the project has started, the initial payment is not refundable
    • We reserve the right to cancel services if these terms are breached
    • If we cancel, the unused proportional part will be refunded

    10. Changes to the service

    We reserve the right to modify, suspend or discontinue any aspect of our services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension or interruption of the service.

    11. Confidentiality

    Both parties agree to keep confidential any privileged information shared while the service is provided. This includes, but is not limited to, business information, marketing strategies and client data.

    12. Governing law

    These terms are governed by and interpreted in accordance with the laws of Spain. Any dispute relating to these terms shall be subject to the exclusive jurisdiction of the courts of Pontevedra, Spain.

    13. Changes to the terms

    We reserve the right to change these terms at any time. Changes take effect as soon as they are published. It is your responsibility to review these terms periodically.
